IN THE HIGH COURT OF DELHI AT NEW DELHI
MS POOJA ARORA & ANR. – Appellant
Versus
MEENAKSHI GUPTA – Respondent

Judgement Key Points

Based on the provided legal document, the key points are as follows:

  • The appeal challenges an order directing the parties to maintain status quo regarding the suit property, pending final adjudication (!) (!) .
  • The dispute involves conflicting claims of ownership and possession, with both sides asserting their title based on registered documents, but disputing each other's validity and authenticity (!) (!) (!) .
  • The plaintiff claims ownership through a registered sale deed dated 04.03.2021 and alleges interference and unlawful acts by the defendants (!) (!) .
  • The defendants contend they are the lawful owners by virtue of an earlier sale deed dated 17.02.2021, and assert their possession has been continuous since 1996, challenging the validity of the plaintiff’s documents as forged or fabricated (!) (!) (!) .
  • Both parties have raised disputed factual issues, including the validity of the title chain, possession, and allegations of forgery, which can only be resolved after evidence is led in the trial (!) (!) .
  • The court upheld the trial court’s decision to maintain the status quo, emphasizing that such an interim order is a balanced measure to preserve the property until the rights of the parties are properly determined (!) (!) .
  • The court clarified that the order does not decide the merits of the case but aims to prevent irreversible prejudice to either party during the trial (!) .
  • The appeal was dismissed on these grounds, and the existing order of status quo was affirmed to ensure the preservation of the property pending the final resolution of the dispute (!) (!) .
