New India Assurance Company Limited – Appellant
Versus
Jiten Chettri – Respondent
Consumer Complaint No. 37 / D / 2011 | First Appeal No. 454 of 2012
Misrepresentation in insurance contracts voids claims, as material nature was not accurately disclosed.
Headnote:This revision has been filed against the order of State Consumer Dispute Redressal Commission, West Bengal wherein it was found that the insurance claim was repudiated based on alleged fraudulent declaration regarding the nature of the insured property. The court emphasized the need for accurate representation in insurance contracts as held in the precedent case. The central question addressed was whether the misrepresentation invalidated the insurance claim, with the court ruling that the claim was rightly repudiated due to material misrepresentation. The revision petition is dismissed with no merit found in the appeal against lower court's findings.
