O R D E R

1. The present writ petition has been filed seeking directions to the respondent no. 1, i.e., BSES Rajdhani Power Limited, to consider and decide the petitioner’s application for grant of a separate and independent electricity connection in respect of the property bearing No. 793, Opposite Metro Pillar No. 707, Village Tikri Kalan, New Delhi-110041.

2. Learned counsel appearing for the petitioner submits that the petitioner is a tenant of respondent no. 2, i.e., Ranvir Singh, in terms of duly notarized Rent Agreement dated 11th March, 2025.

3. As per the case put forth by the petitioner, the Rent Agreement does not contain any clause, authorizing the landlord to levy or collect electricity charges at any enhanced or commercial rate. However, the landlord, subsequently, raised a demand for electricity charges at the rate of Rs. 15 per unit, which the petitioner declined to accept.

4. Thus, in retaliation, the landlord has disconnected the electricity supply to the tenanted premises on 13th October, 2025. Thereafter, the petitioner has made a representation dated 21st November, 2025 to the respondent no. 1 seeking issuance of an independent and separate electricity connection to the tenanted premises. However, no action has been taken till date.

5. Thus, in these circumstances, the petitioner has filed the present writ petition.

6. Responding to the present writ petition, learned counsel appearing for the respondent no. 1, i.e., BSES Rajdhani Power Ltd., submits that the petitioner has not applied to the respondent no. 1 for the purposes of grant of any independent or fresh electricity connection.

7. He submits that the representation dated 21st November, 2025, as submitted by the petitioner, cannot be considered as a formal application for the purposes of obtaining electricity connection.

8. He submits that the petitioner would have to apply through the online process, in terms of Regulation 11 of the Delhi Electricity Regulatory Commission (Supply Code and Performance Standards) Regulations, 2017. Thereafter, the respondent no. 1 shall consider the application in accordance with law.

9. Accordingly, considering the submissions made before this Court, the petitioner is granted liberty to file a formal application with respondent no. 1 for grant of an independent and separate electricity connection to the premises in question.

10. Upon the petitioner making such an application, the same shall be considered by the respondent no. 1, in accordance with law and in a time bound manner.

11. In case, the petitioner is aggrieved by any order/deficiency letter passed by respondent no. 1, the petitioner shall be at liberty to seek remedies in accordance with law.

12. It is clarified that this Court has not expressed any opinion on the merits of the case of the petitioner. Rights and contentions of the parties are left open.

13. With the aforesaid directions, the present writ petition, along with the pending application, is disposed of.
