10. This is an application filed by the plaintiff under Section 12A of the Commercial Courts Act, 2015, read with Section 151 of CPC, seeking exemption from conducting pre-institution mediation

12. Learned counsel for the plaintiff and learned senior counsel for the defendant states that without prejudice to their rights and contentions, parties are willing to consider mediation.

13. With the consent of the parties, parties are referred to Delhi High Court Mediation and Conciliation Centre [‘Mediation Centre’]. Parties are directed to deposit the mediation fee within one (1) week from today.
