O R D E R

1. Application under Section 528 B.N.S.S. has been filed on behalf of the Petitioner for placed on record additional documents and verification of the same by the Police Authority.

2. Learned ASC for the State appears on advance Notice and has not objection, if this Application is allowed.

3. Accordingly, present Application is allowed and documents be taken on record.

4. Application is disposed of.

CRL.M.A. 36997/2025

5. Application under Section 528 B.N.S.S. has been filed on behalf of the Petitioner to recall the directions given in Paragraph 03 in Order dated 06.11.2025, where liberty has been granted to the State, since it was neither prayed nor warranted in the facts of the present case.

Learned counsel for the Petitioner submits that Hon’ble Supreme Court in Suo Moto Writ Petitoin (Criminal) No.4/2021 titled as In Re Policy Strategy for Grant of Bail, vide Order dated 04.11.2025 has noted that ‘respective State shall comply with the earlier Orders, which is inclusive of undertaking the exercised of consideration, at least six months prior to the eligibility of a convict, so that unwanted time by way of incarceration even after a convict become eligible for premature release can very well be avoided’.

7. It is further submitted that Petitioner being out on Bail since January, 2024, is only an endeavour for his rehabilitation in the society and there should not be any directions given for his surrender.

Learned ASC for the State appears on advance Notice and submits that in compliance of directions of the Apex Court dated 08.05.2025, a Division Bench has already been constituted in this regard by the Hon’ble Chief Justice of this Court and the Division Bench is already seized of the matter and Notice has been issued. Therefore, the Judgment, relied upon by the Petitioner, is of no assistance to him.

9. Submissions made in the Applicant are patently without any merit. There is no direction given by the Court for surrendering the Petitioner, but it is only that ‘State is at liberty to issue Notice to the Petitioner to seek his surrender’.

10. It goes without saying that the procedure has to be followed by the State, in accordance with law including any direction, that may have been given by the Apex Court.

11. There is no modification merited in Paragraph 03 in Order dated

06.11.2025, as has been sought by the Petitioner.

12. Accordingly, present Application is dismissed.

CRL.M.A. 37088/2025

13. Application under Section 528 B.N.S.S. has been filed on behalf of the Petitioner for taking on record the objections filed by the Petitioner to the Minutes of the Meeting of the Sentence Review Board, filed on 06.11.2025. 14. Learned ASC for the State appears on advance Notice and submits that this Application may be allowed, with liberty to him to response to these objection in his written submissions, which have been directed to be filed vide Order dated 06.11.2025.

15. Accordingly, present Application is allowed and disposed of.

CRL.M.(BAIL) 2453/2025

16. Application under Section 528 B.N.S.S. has been filed on behalf of the Petitioner seeking suspension of sentence during pendency of the Writ Petition.

17. Learned ASC for the State appears on advance Notice and seeks time to file Reply.

18. The same be filed within 15 days.

19. On request of learned ASC for the State, time for filing written submissions is extended by 15 days, within which the same may be filed on record.

20. List for arguments on date fixed, i.e. 27.01.2026.
