O R D E R

1. The present application has been filed by the Appellant under section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking interim bail for sevenhourson18thJanuary,2026,from9:00a.m.to4:00p.m.,duetodemise of his mother, who is stated to have passed away on 12th January, 2026.

2. It is the case of the Appellant that he could not attend the cremation of his mother. Though he was taken by the jail authorities, by the time the Appellant reached, the cremation had already taken place.

3. Mr. Vikram Panwar, ld. Counsel for the Appellant submits that the Appellant has been granted custody parole even in the past. In this regard, reliance is placed upon the order dated 2^nd May, 2022 wherein the Appellant was granted custody parole to attend the birth of his grandchild and another order dated 22^nd February, 2024, which was passed when the Appellant’s father had passed away.

4. This application was listed on 15^th January, 2026 on which date the Respondent was directed to verify the factum of death of the Appellant’s mother and file a status report.

5. Today, the verification report dated 16^th January, 2026, has been submitted by Ms. Tarannum Cheema, ld Counsel for the State, which has been signed byInsp. Jagdish Kumar, SIT (1984-Riots)/Crime. As per the said report, the death of the Appellant’s mother has been duly verified both from the care taker of the Shamshaan Bhumi, Mahipalpur, Delhi and the attending medical practitioner who had issued the concerned death certificate. The said fact has also been verified fromthe concerned neighbourhood in Mahipalpur, Delhi.

Considering the facts narrated in the application and verified in the status report, the Appellant is granted custody parole for a period of seven hours i.e., from 9:00 AM to 4:00 PM, to attend the Tehravi ceremony of his mother whichistobeheldon18^thJanuary,2026,at DeshramComplex,A-28, Road No. 1, Mahipalpur, Delhi.

7. The concerned Jail Superintendent is directed to make the necessary arrangements, including the escort to enable the Appellant to attend the said Tehravi Ceremony.

8. The Appellant shall be brought back to the concerned jail premises upon the expiry of the period of parole.

9. It is made clear that the police personnel accompanying the Appellant shall be in civil attire and not in uniform.

10. Copy of this order be communicated to the concerned Jail Superintendent for necessary information and compliance.

11. The order be uploaded on the website forthwith.

12. Dasti under signatures of the Court Master.

13. The application is disposed of in the above terms.
