1. The present application has been filed under Section 379 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”), erstwhile Section 340 of the Code of Criminal Procedure, 1973 (“Cr.P.C.”), on behalf of the plaintiff, seeking initiation of proceedings under Sections 227/228/229/240/318, read with Section 61 of the Bharatiya Nyaya Sanhita, 2023, erstwhile Sections 191, 192, 193, 420, read with Section 120-B of the Indian Penal Code, 1860 (“IPC”), against defendant nos. 2 and 3, for perjury
and abuse of process of Court, with respect to the order dated 26th November, 2025.
2. Learned counsel appearing for the plaintiff draws the attention of this Court to the order dated 26th November, 2025, and submits that the statement of defendant nos. 2 and 3 was noted in the said order as follows:

5. Counsel for defendant nos. 2 and 3 submit that defendant no. 1 has already discounted a bill on the basis of their letter of credit and the amounts have been released by defendant nos. 2 and 3 in favour of defendant no. 1.
xxx xxx xxx”
3. However, he submits that no such amount had been released by defendant nos. 2 and 3 in favour of defendant no. 1 on 26th November, 2025, and that the said amount was actually released on 02nd December, 2025.
Thus, the present application has been filed.
4. Issue notice to the non-applicants.
5. Notice is accepted by learned counsel appearing for defendant nos. 2 and 3, who submits that copy of the present application has not been served upon him.
6. Let copy of the present application be served upon learned counsel appearing for defendant nos. 2 and 3, on the E-mail, which is reflected in today’s order.
7. Let reply be filed within a period of four weeks, from today.
8. Rejoinder thereto, if any, be filed within a period of two weeks, thereafter.
9. List before the Joint Registrar (Judicial) on 30th January, 2026, i.e., the date already fixed.
10. List before the Court on 24th March, 2026, i.e., the date already fixed.
