4. The Petitioners, being members of the Superannuation Benefit Fund Scheme of IOCL, have filed this writ petition, challenging certain circulars

issued by the Fund, claiming that these have resulted in a reduction of the benefits to which they were entitled.

5. Issue notice. Mr. Rohan Jaitley, Central Government Standing Counsel, accepts notice on behalf of Respondent No. 2/Union of India. Respondent No. 1/Indian Oil Corporation Limited, “IOCL” be served by all permissible modes, as also through Mr. Amit Meharia, counsel appearing for IOCL in Indian Oil Corporation Limited v. Retired Officers Welfare Society & Ors.

6. Mr. P.S. Datta, Senior Counsel for the Petitioners, submits that the same issue was decided in favour of similarly placed petitioners by a judgment of a Coordinate Bench of this Court in Retired Officers Welfare Society and Ors vs. Indian Oil Corporation Limited and Anr.³ However, it is submitted that the said judgment has been stayed by the Division Bench on an appeal filed by IOCL. The order of the Division Bench dated 28^th May, 2025 in LPAs 363-364/2025 [Indian Oil Corporation Limited v.

Retired Officers Welfare Society & Ors], reads as follows:

“11. In the meantime, while there shall be a stay on the enforcement of the Impugned Judgment passed by the learned Single Judge, at the same time, the appellant shall calculate the differential of pension that would be payable in terms of the Impugned Judgment to the employees, including the arrears, and place the same before this Court at least two weeks in advance of the next date of hearing, by way of an affidavit.”

7. In these circumstances, Mr. Datta seeks to have the present writ petition tagged along with the said LPAs, submitting that the case of the Petitioners herein is identical to that of the respondents in those appeals.

8. In view of the above submissions, and subject to the orders of

Hon’ble the Chief Justice, list this writ petition along with LPAs 363- 364/2025 before the Division Bench on the date fixed therein, i.e., on 9^th April, 2026.
