1. This is a writ petition filed under Article 226 of the Constitution of
India seeking the following prayers:-
“a. Issue a Writ of Mandamus or any other appropriate writ, order or direction to Respondents to immediately open the admission window for the Petitioner for a period of 7 days or any such
reasonable period as deemed fit;
b. Issue a Writ of Mandamus or any other appropriate writ, order or direction to the Respondent No.1 and Respondent No.4 to accept the Part Academic Fee of Rs. 96,000/- and the remaining fees from the Petitioner and complete his admission formalities for the MBBS Course for the Academic Session 2025-26 against the seat allotted to his in the Special Stray Vacancy Round;
c. Issue a Writ of Mandamus or any other appropriate writ, order or direction that the seat allotted to the Petitioner (Roll No. 103251006112) at Dr. BSA Medical College be kept vacant and not treated as a stray vacancy until the disposal of this petition;”

The brief facts are that the petitioner appeared for the National Eligibility Cum Entrance Test (NEET-UG) 2025 conducted on 04.05.2025 and the result of the same was declared on 14.06.2025, wherein the petitioner secured an All India Rank (AIR) of 38090. Thereafter, the petitioner duly registered with Guru Gobind Singh Indraprastha University (GGSIPU) i.e., respondent No. 1 for MBBS Counselling (Prog Code 103)
and paid the requisite counselling fees.
3. The petitioner participated in four rounds of counselling and subsequently, a 5th round, namely “Special Stray Vacancy Round”, was conducted on 18.12.2025 to fill the remaining vacant seats and the petitioner participated in the same.
4. Prior to declaration of results of 5th round, the respondent No. 1 issued Notification dated 26.12.2025 titled “Schedule of Activities Pursuant to the Declaration of Result of Special Stray Vacancy Round”, wherein the respondent No. 1 provided a deadline for payment of part Academic Fee (amounting to Rs. 96,000/-) till 30.12.2025 (11:59 PM), and thereafter, for reporting to the Allotted Institute from 29.12.2025 to 31.12.2025.

On 01.01.2026, the petitioner logged into her University portal and discovered that she was allotted a seat in respondent No. 4 college and consequently, rushed to the University authorities to complete admission formalities but was informed that her admission could not be processed as the portal was closed and the deadline had passed.
6. On 02.01.2026, the respondent No. 1 published a public notice/list on its website titled “GGSIPU_MBBS ALLOTTED CANDIDATES_SPECIAL STRAY ROUND_2025-2026”. The petitioner found her roll number listed against Dr. BSA Hospital, Medical College i.e., respondent No. 4.
7. The petitioner wrote to the concerned authorities as well as the respondent No. 1 seeking extension and grant of admission. However, the same was of no recourse.

It is stated that the National Medical Commission i.e., respondent No. 2 has issued a Public Notice dated 05.01.2026, calling upon all the Medical colleges/Institutions to submit the requisite admission details of all the students admitted for MBBS during the current academic year 2025-26, vide the NMC portal latest by 15.01.2026, 12:00 mid-night.
9. Hence, the present petition.
