4. The present application has its origin in the amendments carried out in the Code of Criminal Procedure (Cr.P.C) in the year 2009. More particularly with respect to the definition of victim which was added under Section 2(wa) and Proviso added to Section 372 Cr.P.C giving certain rights to the

victims / complainant.

5. The Proviso added to Section 372 Cr.P.C provided that complainant / victim can prefer an
