1. This is a petition filed under Article 226 of the Constitution of India

seeking the following prayers:

“a. Issue a Writ of Mandamus or any other appropriate

writ, order or direction to Respondents to immediately open the admission window for the Petitioner for a period of 3 days or such reasonable time as deemed fit;

b. Issue a Writ of Mandamus or any other appropriate writ, order or direction to the Respondent No.1 and Respondent No.4 to accept the Part Academic Fee of Rs. 96,000/- and the remaining fees from the Petitioner and complete her admission formalities for the MBBS Course for the Academic Session 2025-26 against the seat allotted to her in the Special Stray Vacancy Round;

c. Issue a Writ of Mandamus or any other appropriate writ, order or direction that the seat allotted to the Petitioner (Roll No.103251015402) at Dr. BSA Medical College be kept vacant and not treated as a stray vacancy until the disposal of this petition;”

The brief facts of the case are that the petitioner appeared for the National Eligibility Cum Entrance Test-UG (“NEET-UG”) conducted on 04.05.2025 and secured 525 marks out of 720 (98.72 Percentile) with all All India Rank of 28091. Further, the petitioner registered for counseling with the respondent No. 1 university, namely Guru Gobind Singh Indraprastha University by paying the requisite fee. She participated in all rounds of vacancy including the 5th round i.e. the “Special Stray Vacancy Round" of counseling. Subsequently, the Petitioner was allotted a Government Seat at the respondent No. 4 College, namely Dr. Baba Sahab Ambedkar Medical College.

3. The respondent No.1 issued a Notification dated 26.12.2025, wherein as per the petitioner, the deadline for fee payment was unreasonably short and unjust. The petitioner was granted only about two days, i.e. from 29.12.2025 to 31.12.2026 to make the requisite fee payment. However, the actual Public Final Allotment List revealing the selection was only made available/published on the University website on 02.01.2026.

4. Further, by that time deadline for fee payment and for reporting to the university already elapsed, and the petitioner was not permitted to deposit her fee with respondent No. 4 despite several requests. Hence, the present petition is filed.

5. In view of the above, issue notice.

6. Ms. Sahni, learned counsel, accepts notice on behalf of respondent No. 1, Ms. Rudy, learned CGSC accepts notice on behalf of respondent No. 2 i.e. Medical Counselling Committee, Ms. Agrawal, learned counsel accepts notice on behalf of respondent No. 3 i.e. National Medical Commission, and Ms. Gupta, learned counsel accepts notice on behalf of respondent No. 4 College.

7. It is stated that there are seats available in the respondent No. 4 College.

8. However, Ms. Gupta, learned counsel for the respondent No. 4, states that a list has already been sent on 13.01.2026. However, since the deadline for the Medical colleges/Institutions to submit the requisite admission details of all the students admitted for MBBS during the academic year 2025-26 is 15.01.2026, another list can be sent and should be sent including the name of the petitioner.

9. In the present case, the petitioner has secured admission in “Special Stray Vacancy Round” of counselling on merits and is ready a
