1. The matter has been released from being part-heard by the previous
Roster Bench.
2. The matter has to be heard finally.
3. One of the grievances of the petitioner is that the President as well as the Secretary General of the respondent no.2 continue to function in
violation of the National Sports Development Code of India, 2011.
4. Counsel appearing on behalf of the respondent no.2/Gymnastics
Federation of India, submits that the Secretary General of the Association Mr. Shanti Kumar Singh has ceased to operate as the Secretary General since February, 2024.
4.1. The statement is taken on record.
5. Counsel for the respondent no.2 submits that the President of the respondent no.2/Gymnastics Federation of India, Mr. Sudhir Mittal continues to function as the President of the Association since the elections have been stayed by this Court in the present petition.
6. Counsel appearing on behalf of the respondent no.1/ UOI submits that the National Sports Governance Act, 2025 (hereinafter ‘the Act’) has been notified on 31st December, 2025 and the Rules thereunder have been partially notified on 12th January, 2026.
7. In terms of Rule 18(1) of the National Sports Governance (National Sports Bodies) Rules, 2026, all national sports bodies are required to amend their bye-laws in conformity with the provisions of the Act, within six (6)
months.
8. In these facts and circumstances, the respondent no.2/Gymnastics Federation of India shall take steps to amend the bye-laws to bring it in conformity with the provisions of the Act.
9. The respondent no.1/UOI shall file an affidavit, stating whether elections to the National Sports Associations can take place under the mechanism put forth under the Act. The Union of India shall also clarify which of the Rules framed under the aforesaid Act have been notified till date.
9.1. The affidavit shall be filed within four (4) weeks from today.
10. Respondent no.2/Gymnastics Federation of India shall also file an affidavit, at least one (1) week before the next date of hearing, regarding the steps taken to amend their bye-laws. The affidavit shall also clearly specify the various Officials, who are holding posts in the Gymnastics Federation of India.
