HON'BLE MR. JUSTICE PURUSHAINDRA KUMAR KAURAV

% 14.01.2026
CM APPL. 722/2026
1. The instant application is seeking for permission to allow the petitioner no.1 - Mohd. Saleem to travel to Dubai for a period of ten days
commencing from 23.01.2026 till 03.02.2026 to attend the exhibition.
2. Learned counsel appearing for the Bank of Baroda which seems to be the originating authority, on instructions, fairly contends that after due investigation the bank is contemplating to issue directions for withdrawal of the LOC. He, therefore, submits that as of now the bank does not have any
objection if the instant application is allowed.
3. The instant petition is by the three petitioners. They are father and sons. One of the sons namely – Mohd. Saleem (the applicant herein) seeks to undertake the stated journey. The LOC was issued at the instance of the
bank and the bank itself contemplates its reconsideration.
4. Thus, there exists no reason as to why the petitioner no.1 - Mohd. Saleem should not be allowed to attend the exhibition and networking at World Trade Centre, Dubai.
5. The Court, however, in the interest of justice prescribes following conditions to be fulfilled before the petitioner no.1 - Mohd. Saleem leaves India:
i. The petitioner no.1 - Mohd. Saleem shall furnish a security of Rs. 25 lakhs in the form of an FDR, which shall be furnished to the Registrar General of this Court.
ii. The petitioner no.1 - Mohd. Saleem shall furnish the bank statements in respect of bank account/s held by the petitioner no.1 - Mohd. Saleem in any foreign country for the period since the date of the opening of the said bank account/s till date. The petitioner no.1 - Mohd. Saleem shall also not operate any foreign bank account/s while travelling to Dubai iii. The petitioner no.1 - Mohd. Saleem shall file a detailed affidavit disclosing his complete itinerary, including his stay at various locations abroad as well as telephone numbers and residential/ hotel addresses. He shall also file an undertaking that he shall strictly adhere to the itinerary mentioned in the affidavit and not visit any other stations. He shall also furnish a copy of the air tickets purchased by him before the Registrar General of this Court;
iv. The petitioner no.1 - Mohd. Saleem shall also provide the contact numbers that he would use during the period of stay abroad, and at least one of the said contact numbers will be kept operational at all times, subject to all fair exceptions, including the period he is on board the aircraft;
v. The petitioner no.1 - Mohd. Saleem shall file an undertaking before the Registrar that he shall return to the country on 03.02.2026. The petitioner no.1 - Mohd. Saleem shall intimate the Registrar General of this Court before leaving and within 72 hours of his return;
vi. The petitioner no.1 - Mohd. Saleem shall file a self-attested copy of his passport along with a copy of his visas, on his return to India.
6. The permission to travel abroad given in this order shall be subject to all other applicable conditions and shall not be deemed as a direction to any other authority.
7. The application is disposed of in the above terms.
8. List before the Joint Registrar (Judicial) for verification of documents on 16.01.2026.
W.P.(C) 2253/2025
9. Since the bank itself is reconsidering the decision of opening the LOC, therefore, there is no reason to keep this petition pending. Instead, the Court deems it appropriate to dispose of the same, granting the liberty to file afresh, if occasion arises.
10. If during pendency of the present LOC, if the petitioners intend to further undertake any abroad journey, they shall be at liberty to file a fresh petition.
