1. This application under Section 5 of the Limitation Act,

1963 has been filed on behalf of the appellant seeking condonation

of delay of 120 days in filing the appeal.

2. For the reasons stated in the application, the delay of 120

days is condoned.

5. This application under Sections 430 and 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (Sections 389 and 482 of the Code of Criminal procedure, 1973) has been filed on behalf of the appellant/accused no. 1 in Sessions Case No. 59105/2016 on the file of Additional Sessions Judge-03, North District, Rohini Courts, Delhi, seeking suspension of sentence. The appellant has been found guilty of the offences punishable under Sections Vide

304(Part-II) and 308 of the IPC. order dated 07.05.2025, he has been sentenced to imprisonment for a period of four years and fine of ₹ 10,000/- for the offence punishable under Section 304(Part-II) IPC and simple imprisonment for a period of three years along with fine of ₹ 5,000/- for the offence punishable under Section 308 IPC. The sentences have been directed to run concurrently.

6. It is brought to my notice that the co-accused has been granted bail as per order dated 06.08.2025.

7. The learned counsel appearing for the victim opposes the application and submits that grievous injuries had been caused to him as well as his parents and therefore, suspension of sentence is not called for.

8. The application is not opposed by the Additional Public Prosecutor, as the co-accused has been granted bail.

9. Heard both sides.

10. As the sentence is only for a period of four years and there is no criminal antecedents, the sentence of the appellant is suspended during the pendency of the appeal on execution of a bond of ₹15,000 with two solvent sureties for the like amount each to the satisfaction of the trial court, subject to the following conditions:-

(i) The appellant will provide his mobile numbers to the Station House Officer (SHO) concerned, on which he shall remain available during the pendency of the present appeal. In case of change in the number, he shall inform the SHO forthwith.

(ii) In case of change of residential address or contact detail, the appellant will promptly inform the SHO concerned as well as this Court.

(iii) The appellant shall not directly/indirectly contact or attempt to contact in any manner whatsoever the victim or his family members or go near their residence.

(iv) The appellant shall appear before the Court as and when directed.

(v) The appellant will not leave the country without the prior permission of this Court.

(vi) The appellant will not commit any offence(s)

while on bail.

11. With the above directions, the application is disposed of.

12. A copy of this order be communicated electronically to the Jail Superintendent concerned for information and compliance.
