1. This is a writ petition filed under Article 226 of the Constitution of

India seeking the following prayers:-

“A.) Issue an appropriate writ, order or direction quashing and setting aside the order dated 28.04.1995 passed by the Dy. Director (CL), Delhi Development Authority (DDA), cancelling the allotment of the Entire, Plot No. 75-76, Nehru Place,

Kalkaji District Centre, New Delhi – 110019;

B.) Issue an appropriate writ, order or direction, thereby quashing the Show cause notice dated 19.09.2025 issued by the

Ld. Estate officer DDA and the eviction proceedings pending before the Ld. Estate Officer, DDA, against the members of the Petitioner Association;”

Mr. Mata, learned senior counsel for the petitioner states, amongst other grounds, that in the present case no show-cause notice for misuser has ever been issued against most of the apartment owners of the Manisha Building. He further states that the notices for misuser and unauthorized usage has only been issued to respondent Nos. 3 and 4, who have long time back sold/ transferred possession and ownership to various apartment owners in the building. Hence, the entire proceedings of the Estate Officer are without following principles of natural justice.

3. For the said reasons, issue notice to the respondents.

4. Mr. Sannu, learned counsel accepts notice on behalf of respondent Nos. 1 and 2, seeks and is granted 1 week to file a reply.

5. Issue notice to all other respondents through all modes including electronic on the petitioner taking steps within 1 week from today, returnable on 16.02.2026.

6. This is an application filed under Article 226 of the Constitution of India read with Section 151 of the CPC, 1908 seeking the following prayers:-

“A) Stay the operation and effect of the impugned order dated

28.04.1995;

B) Stay the proceedings pending before the Ld. Estate Officer, DDA, in respect of Plot No. 75-76, Nehru Place, New Delhi-

110019, during the pendency of the present writ petition;

B) Direct the Respondents not to take any coercive action including eviction, sealing, or any other adverse steps against the petitioner association or its members in respect of the said premises;” 7. For the reasons stated in the application, issue notice.

8. Mr. Sannu, learned counsel accepts notice on behalf of respondent Nos. 1 and 2, seeks and is granted 1 week to file a reply.

9. Issue notice to all other respondents through all modes including electronic on the petitioner taking steps within 1 week from today, returnable on 16.02.2026.

10. Mr. Sannu, learned counsel for the respondent Nos. 1 and 2 states that the next date before the Estate Officer is 18.03.2026.

11. Since the matter is kept prior to 18.03.2026 and hence, only notice is issued in the stay application.
