IN THE HIGH COURT OF DELHI AT NEW DELHI
Amit Bansal, J
Farhat – Appellant
Versus
Govt. Of Nct Of Delhi – Respondent
W.P.(C) 7968/2023
For the Appellants/Petitioners: Sonal Sinha
For the Respondents: Abhinav Sharma, Mahender Shukla
The Court holds that municipal authorities are empowered and obligated to execute the demolition of structures identified as dangerous by expert structural assessments to ensure public safety and prevent collapse, provided the action is restricted to the specific portions deemed unsafe.
Headnote:The petitioner filed a writ petition seeking an order for the demolition of a property declared dangerous by the municipal authorities. Following an independent structural safety assessment ordered by the court, the structural engineer certified that portions of the building were unsafe and posed a significant risk of collapse. The primary issue before the court was the immediate necessity to address the structural integrity of the property to prevent potential loss of life and property. The court analyzed the structural engineer's findings, which identified specific dangerous portions, and determined that the municipal authority was mandated to take necessary demolition actions for those identified unsafe areas to protect the public and occupants. The writ petition is disposed of with a directive to the municipal authority to execute the demolition of the dangerous northern and southern portions of the property in strict accordance with the structural engineer's report, while leaving the stable portions identified in the report intact.
