The court observed that, pending final adjudication, the transfer of membership could proceed subject to the outcome of the writ petition, whereas the transfer of parking rights remains stayed.

Result: The court admitted the petition, issued notice, and granted interim relief regarding the stay of parking rights transfer while permitting conditional membership transfer.

The present petition has been filed by the Petitioner Society under Articles 226 and 227 of the Constitution of India, inter alia, assailing the impugned order dated 20th November, 2025 passed by the ld. Financial Commissioner, Delhi and impugned order dated 3rd April, 2025 passed by the ld. Additional Registrar, Co-operative Societies, Delhi.

4. A brief background of the case is that, vide the impugned order dated 3rd April, 2025, the ld. Additional Registrar had directed the Petitioner Society to transfer the membership in the name of Respondent No.3- Mr. Vinod Kumar Syal of Flat No. 231, Guru Cooperative Group Housing Society Pvt. Ltd., Plot No. 2, Sector-6, Dwarka, New Delhi-110075 within seven days. Vide impugned order dated 20th November, 2025 the ld. Financial Commissioner had upheld the impugned order dated 3rd April, 2025.

5. Mr. Munjal, ld. Sr. Counsel for the Petitioner Society submits that the wife of Respondent No.3 had a membership in another society i.e., M/s. Unique Insurance Cooperative Group Housing Society Pvt. Ltd., Sector-6, Dwarka which operated as a disqualification and the necessary forms were also not filed by Respondent No.3.

6. Issue notice to all the Respondents through all permissible modes, upon appropriate steps being taken by the Petitioner Society.

7. Ms. Urvi Mohan, ld. Counsel accepts notice for Respondent Nos. 1 2, and 4.

8. Mr. Sandeep Kumar, ld. Counsel accepts notice for Respondent No. 3.

9. Considering the nature of the matter, it is directed that the membership may be transferred in favour of Respondent No. 3. However, the same shall be subject to the outcome of this petition.

10. The parking may also be used by the Respondent No. 3. However, the transfer of the parking shall remain stayed, till the next date of hearing.

11. Let the reply be filed within a period of four weeks. Rejoinder thereto, if any, be filed within a period of four weeks, thereafter.

12. List on 19th March, 2026.
