O R D E R

CRL.M.(BAIL) 31/2026

1. The present application has been filed on behalf of the appellant under Sections 528 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking release of the appellant on interim bail for a period of two weeks to attend the last rites and prayer meet of his demised father.

2. Issue notice.

3. Learned Additional Public Prosecutor accepts notice on behalf of the respondent/State.

4. Heard both sides.

5. The learned Additional Public Prosecutor for the respondent/State has verified the fact that the father of the appellant/accused passed away on 31.12.2025.

6. Hence, keeping in view the aforesaid circumstances, the appellant/accused is granted interim bail for a period of two weeks starting from 12.01.2026 to 26.01.2026 on the appellant executing a personal bond of ₹25,000/- with two solvent sureties of the like amount each, subject to the satisfaction of the trial court, on the following conditions:

(i) The appellant shall provide his mobile number to the Station House Officer concerned on which he shall remain available during the period of his release. If he changes the number, the SHO concerned shall be informed without delay.

(ii) The appellant shall not commit any offence while on bail.

(iii) The appellant shall report before the Jail Superintendent concerned on 27.01.2026 by 10:00 a.m.

(iv) In the event of violation of any of the aforementioned conditions, the interim bail granted shall forthwith stand cancelled.

7. The application is disposed of as stated aforesaid.

8. A copy of this order be communicated electronically forthwith to the Jail Superintendent concerned for information and necessary compliance.

9. A copy of this order be given dasti.
