O R D E R

08.01.2026

1. The present writ petition has been filed seeking a direction to respondents no.1 to 3 to take action against illegal and unauthorised construction being carried out in the property bearing No. 575, Khasra No. 740/496, Lal Dora Abadi, Village Chirag Delhi, Tehsil Hauz Khas (Mehrauli), New Delhi-110017.

2. It is stated that the petitioner is a neighbour who resides in property No.574, Chirag Delhi, New Delhi-110017, in the same vicinity and the raising of the illegal construction is adversely affecting the petitioner.

3. Issue Notice.

4. Notice is accepted on behalf of counsel for the respondents.

5. Counsel appearing for the respondent no.3/STF submits that the complaint dated 14th October 2025 has been forwarded to the respondent no.1/MCD for an appropriate action and the respondent no.3/STF is monitoring the same.

6. Counsel appearing for the respondent no.1/MCD submits that the aforesaid property has been booked and a show cause notice has been issued on 16th October, 2025. This was followed by a demolition order dated 7th November, 2025.

7. It is submitted on behalf of respondent no.1/MCD that on 4th December, 2025, the partition wall in the property has been punctured and the respondent no.1 proposes to take full action on 13th January, 2026.

Counsel appearing for the respondents no.7 and 8, i.e. the private respondents, submits that the said respondents are the owners of property bearing No.575-A, Chirag Delhi Village, New Delhi and the relief sought in the petition is only qua property No.575, Khasra No. 740/496, Lal Dora Abadi, Village Chirag Delhi, Tehsil Hauz Khas (Mehrauli), New Delhi-110017.

9. Counsel for the petitioner clarifies that the entire property comes within the ambit of property No.575, Khasra No. 740/496, Lal Dora Abadi, Village Chirag Delhi, Tehsil Hauz Khas (Mehrauli), New Delhi-110017.

10. Considering the aforesaid submissions made on behalf of counsel for the parties, the present petition, along with the pending application, stands disposed of.
