I.A. 156/2026 (Exemption)

1. This is an application under Section 151 of CPC seeking exemption from filing typed copy of the illegible copies of the documents. For the reasons stated, the same is allowed subject to all just exceptions.

4. This is an application filed under Section 151 CPC, 1908 seeking permission to place on record the pen drive containing video recording of the original work of the plaintiff as well as the infringing scene as uploaded by the plaintiff’s followers on social media.

5. For the reasons stated in the application, the same is allowed.

6. The pen drive stated to be containing the videos of the original work of the plaintiff as well as the infringing scene be placed on record within three days from today along with the appropriate certificate under the Indian Evidence Act, 1872.

I.A. 153/2026 (Exemption from filing pre-litigation mediation)

10. This is an application on behalf of plaintiff under Section 12-A of the Commercial Courts Act, 2015. Since the applicant is seeking urgent interim relief, in terms of the judgment of the Hon’ble Supreme Court in Yamini Manohar vs. TKD Keerthi 2023 SCC OnLine SC 1382, the exemption from requirement of pre-institution mediation is granted. The application stands disposed of.

11. This is an application under Order XI Rule 2 CPC, 1908 read with Chapter IV of the Delhi High Court (Original Side) Rules, 2018 and Section 151 of the CPC, 1908 seeking interrogatories from the defendants.

I.A. 151/2026 (Interim Injunction)

13. This is an application Under Order XXXIX Rules 1 & 2 CPC, 1908 read with Section 151 of the Code of Civil Procedure, 1908, seeing an interim injunction restraining the Defendants, their partners, directors, officers, employees, agents, licensees and all others acting for or on their behalf from releasing, exhibiting, distributing, broadcasting, streaming, communicating to the public and/or otherwise exploiting the cinematograph film titled “Mastiii 4” through theatres, OTT platforms, satellite television, digital platforms and/or any other medium whatsoever, to the extent it contains, incorporates, reproduces and/or otherwise contains an adaptation of the plaintiff’s underlying works embodied in the original work titled “Shaq Karne Ka Nateeja”, or any substantial part thereof, specifically the infringing scene appearing from time stamp 14:50 to 16:16 of the said Film and also seeks passing of an ex parte ad interim order in the above terms.

14. Keeping in view the fact that the plaint avers that the film was already released in theaters on 21.11.2025 and is slated to be released on the OTT platforms on 16.01.2026, it is deemed appropriate to issue a short notice so as to ensure that the non-applicant/defendants are heard before any interim orders are passed.

16. Notice be served upon the non-applicant/defendants upon the plaintiff taking steps within three days.

17. Reply be filed within four days from date of service.

18. The defendants are directed to be ready with the arguments and have their documents ready on the next date of hearing.
