1. This application has been filed seeking interim suspension of sentence
in FIR No.1/2019 registered under Sections 397/392/34 IPC at PS
Daryaganj, for a period of 30 days on account of death of applicant’s father
on 27th December 2025. The burial ground / cremation ground receipt issued
by Municipal Corporation of Delhi (MCD) has also been placed on record,
along with this application.
2. The application for seeking regular suspension of sentence being
CRL.M.(BAIL) 2341/2025 is coming up before the Roster Bench on 21st
January 2026.
3. Issue notice.
4. Assistant Public Prosecutor (APP) for the State accepts notice; status
report be filed before the next date of hearing.
5. Nominal Roll of applicant/appellant be also summoned from the Jail

6. APP for the State informs that factum of death of applicant’s father
stands verified.
7. Accordingly, sentence of applicant/appellant shall remain suspended
till the next date of hearing i.e. 21st January 2026, subject to furnishing a
personal bond in the sum of ₹10,000/- with one surety bond of the like
amount, subject to the satisfaction of the Jail Superintendent and further
subject to the following conditions:
7.1 Appellant will not leave the country without prior permission of
the Trial Court;
7.2 Appellant shall provide permanent address to the Trial Court. The
appellant shall intimate the Court by way of an affidavit and to the
IO regarding any change in residential address.
7.3 Appellant shall appear before the Court as and when the matter is
taken up for hearing.
7.4 Appellant shall provide all mobile numbers to the IO concerned
which shall be kept in working condition at all times and shall not
switch off or change the mobile number without prior intimation to
the IO concerned.
7.5 Appellant shall not indulge in any criminal activity and shall not
communicate with or come in contact with the complainant/victim
or any member of the complainant/victim’s family or tamper with
the evidence of the case.
8. Copy of the order be sent to the Jail Superintendent for information
and necessary compliance.
