1. The present Writ Petition, filed under Article 226 of the
Constitution of India, challenges the Appropriation Order, bearing
F.No. NA-104/24/2023-NA, dated 23.12.2025, issued by the
Respondent No. 1 herein. By way of the said Appropriation Order, a
sum of ₹1,25,25,322.30/- has been appropriated by invocation of Bank
Guarantee No. 0962023BG0000127 dated 02.05.2023, pursuant to a
Show Cause Notice dated 31.07.2024, alleging non-compliance of the
‘efficiency parameters’ stipulated under the Coal Mine Production &
Development Agreement dated 29.03.2023 in respect of the Patal East
(Eastern Part) Coal Block.

over an hour.
3. Learned counsel for the Petitioner has made a valiant and
commendable effort to put across his case; however, upon this Court
expressing its disinclination to grant any relief, learned counsel for the
Petitioner seeks leave to withdraw the present petition with liberty to
avail appropriate remedies in accordance with law.
4. Liberty, as sought for, is granted.
5. Accordingly, the present Petition, along with pending
application(s), if any, is dismissed as withdrawn.
