1. Heard the learned counsel for the parties.

2. This petition purportedly in public interest has been filed with the

following prayers:-

1. Issue a Writ of Mandamus or any other appropriate writ

directing the respondents to immediately remove:-

(i) All 221 permanent illegal structures/shops (as per Annexure P-

14) identified by PWD on Phirni (Circular) Road, Najafgarh;

(ii) 19 illegal shops constructed in front of Shiv Mandir near

Najafgarh Metro Station(Annexure P-3);

(iii) Illegal vegetable markets at Jharoda Stand Najafgarh(Annexure

P-2);

(iv) The electric transformer at the corner of Khaira Mod crossing

Annexure P-5);

(v) The "Piyau" (public water kiosk/Traditional public drinking

water station) at Jharoda Stand(Annexure P-1);

(vi) Shops in front of Shri Krishan Mandir Furniture

Market(Annexure P-4) and adjacent to HP Petrol Pump at Dhansa

Metro Station(Annexure P-6).

(vii) Unauthorized parking of private buses at the corner of Jharoda

Stand, which causes daily congestion, obstruction of traffic, and risk

to pedestrians, and to direct the Respondents to ensure that no

private or commercial buses are allowed to park or halt at that

junction.

2. Issue appropriate directions to the Traffic Police and other

concerned authorities to ensure that no overloaded trucks or

tractor-trolleys without registration plates carrying bricks are

permitted to enter or ply on Phirni (Circular) Road, Najafgarh,

during the notified no-entry hours from 7:00 AM. to 11:00 P.M.;

and to further direct the said authorities to:

a) Make the CCTV cameras installed at the entry and exit

points fully functional;

b) Take strict enforcement measures including imposition of

fines, seizure of heavy vehicles, and deployment of adequate

police personnel at all entry points to prevent such violations;

and

c) Submit periodic compliance reports before this Hon'ble

Court regarding the enforcement of traffic restrictions.

3. Direct the Respondents to conduct an independent administrative

inquiry, by a senior officer not below the rank of Deputy

Commissioner of Police, or by a duly constituted committee, into the

following matters of grave public concern:

(i) The registration of FIR Nos. 171/2023 (Annexure P-16),

279/2023 (Annexure P-18). and 60/2024 (Annexure P-20)

under Section 188 IPC at Police Station Baba Haridass

Nagar only against a vegetable vendor, Shri Sanjay

Mahaldar, by falsely altering his name, address, and age, in

relation to alleged encroachment of the footpath at Jharoda

Stand, Najafgarh; and

(ii) The mishandling of the fatal accident case registered as

FIR No. 492/2024 (Annexure P-25 & P-26) at Police Station

Chhawla, wherein a false challan was allegedly filed before

the Dwarka Court, thereby obstructing the course of justice.

4. Award the exemplary costs/damages against respondents for

harassment, abuse of legal process, and persistent non-compliance

with judicial orders.

5. Pass any other order(s) as this Hon'ble Court may deem fit and

proper in the interest of justice and public interest.”
