1. The matter has been received on transfer on account of urgent

mentioning since the Roster Bench is not holding Court today.

2. Let the plaint be registered as a suit.

3. Issue summons.

4. Summons be issued to the defendant through all permissible modes.

5. The summons shall state that the written statement shall be filed by

the defendant within thirty (30) days from the date of the receipt of

summons. Along with the written statement, the defendant shall also file

affidavit of admission/denial of the documents of the plaintiff, without

which the written statement shall not be taken on record.

6. Liberty is given to the plaintiff to file replication, if any, within thirty

(30) days from the receipt of the written statement. Along with the

replication filed by the plaintiff, affidavit of admission/denial of the

documents of the defendant be filed by the plaintiff.

7. It is made clear that any unjustified denial of documents may lead to

an order of costs against the concerned party.

8. If any of the parties wish to seek inspection of any documents, the

same shall be sought and given within the timelines.

9. List before the Joint Registrar on 20th February, 2026.

10. List before Roster Bench on 27th April, 2026.

I.A. 32856/2025 (under Order XXXIX Rules 1 and 2 of the CPC

11. The present suit has been filed seeking partition along with other

ancillary reliefs.

12. The plaintiff owns 50% undivided share in the property bearing no. A-

160, Shivalik, New Delhi, admeasuring 191.36 sq. yds. (hereinafter ‘suit

property’) along with his mother, the defendant, who owns the remaining

50% share.

13. It is the case of the plaintiff that the ground floor and first floor of the

suit property were interconnected through a staircase from the lobby of the

ground floor to the first floor and the said property has been constructed as a

duplex house. However, the plaintiff’s father got the said staircase/passage

sealed, thereby restricting the plaintiff’s access to the first floor of the suit

property. Photographs of the suit property have been placed on record.

14. A legal notice dated 30th November 2025 was sent on behalf of the

defendant through her attorney Mr. K. L. Sachdeva, who is the father of the

plaintiff, claiming that there has already been an oral partition between the

parties and therefore, the defendant would be entitled to sell her 50% share

in the suit property. The plaintiff was also given an option to purchase the

share of the defendant for a sum of Rs. 6.50 crores.

15. The aforesaid legal notice was replied to on behalf of the plaintiff on

8th December 2025, whereby the oral partition has been denied. The plaintiff

also offered to purchase the share of the defendant for a sum of Rs. 5.50

crores.

16. The plaintiff apprehends that the defendant may sell her 50% share in

the suit property and hand over the possession of a certain portion of a part

of the suit property.

17. None appears on behalf of the defendant despite advance service.

18. Issue Notice.

19. Notice be issued to the defendant through all permissible modes,

including e-mail.

20. Reply be filed within four (4) weeks.
