1. This is a joint Application under Order XXIII Rule 3 read with Section
151 of the Code of Civil Procedure, 1908.
2. The learned Counsel for the Parties submit that during the pendency of the present Suit, the Defendants approached the Plaintiff and offered to settle
the disputes by giving up the use of the Impugned Mark, ‘ ’.
3. Accordingly, the Parties have decided to settle the disputes amicably
and arrived at the settlement terms (“Terms of Settlement”) as under:
“i. The Defendants hereby acknowledge that all rights, title,
interest, and goodwill in the trademarks SUPERON /
,andallitsformativemarksandvariants(asmentionedinparagraph 4 of the plaint), in present or in future, belong exclusively to the Plaintiff and the Defendants have no rights, titles or interest in the
said trademarks whatsoever.
ii. The Defendants also acknowledge that the Plaintiffs aforesaid
