1. The abovesaid application has been filed by respondent No.2, Mr.

Gulshan Pahuja, under Section 528 of BNSS, 2023 seeking to allow audio-

video recording of the proceedings in the present petitions. To buttress his

such contention, respondent No.2, appearing in-person has placed reliance

on Suo Moto vs. Satish Mahadeorao Uke: 2017 SCC OnLine Bom 9980 and

read out few paragraphs of the said judgment.

2. The abovesaid judgment is, strictly speaking, not applicable to the

present factual matrix.

3. Though respondent No.2 has not been able to given any cogent or

legally sustainable reason, warranting such recording of the proceedings, we

permit the same, primarily, for the reason that he is defending the present

contempt petition, all by himself and has refused to avail any legal

assistance. Moreover, we note that he is walking on a thin line, as during his

arguments, he, referred to certain aspects which had no bearing with the

contempt petition and rather had the potential to invite another contempt

action.

4. The present application is, accordingly, allowed and the Court Master

would ensure that the proceedings of the present case are recorded through

Webex platform, now onwards.

5. There are two different contempt petitions which arise on account of

publication of videos on the YouTube channel titled “Fight 4 Judicial

Reforms”. The uploader and publisher is respondent No.2, Mr. Gulshan

Pahuja.

6. In CONT.CAS.(CRL) 3/2025, as per the material placed before us,

the contemnor/respondent No. 2 had interviewed Shri Shiv Narayan Sharma,

Advocate (respondent No.1), with emphasis on audio-video recording of all

pending cases.

7. Such interview was, eventually, published by respondent No.2 on his

said YouTube Channel on 29.10.2024 and 05.01.2025. The contents of the

videos remain, more or less, the same. The discussion is about the cases

pending in the Court of two judicial officers in particular i.e. Ms. Charu

Aiswal and Mr. Ajay Narwal.

8. The banner/thumbnail/title of one such video is contemptuous and

scandalous, indicating if the cases were pending before the aforesaid two

judicial officers, there was no hope for justice.

9. Admittedly, the other contemnor i.e. respondent No.1 already

tendered his unconditional apology. We will deal with the above apology at

a later appropriate stage of the case. He is, how
