1. This writ petition is preferred on behalf of the Petitioners under
Article 226 of the Constitution of India seeking the following reliefs:-
“a. Issue a writ in the nature of mandamus of any other suitable writ
directing the Respondents to allow the Petitioners to appear in all the
subjects in the supplementary exams of BDS 2nd year to be conducted in
October/November 2024;
b. Direct that the Respondents would declare the results of these
subjects and in case the Petitioners succeed in clearing the 2nd year
exams, allow the Petitioners to attend classes for the 3rct year of the
BDS course at the Respondents institute as also to appear in the 3rct
year exams of the Institute for BDS.
c. Pass such other further order or orders as this Hon’ble Court may

##PAGE2##deem fit and proper in the facts and circumstances of the case and in the
interest of justice.”
2. Learned counsel appearing on behalf of Respondents No. 1 and 2/
Jamia Millia Islamia submits that an amicable solution has been found in the
matter in the interest of the Petitioners and as a one-time exceptional
measure and in this regard hands over an e-mail dated 23.12.2025, wherein
it is stated that the Competent Authority of the University has decided to
take a lenient view in the matter in accordance with norms and regulations
and Ordinances of the University and it is decided that shortage of
attendance of the Petitioners in 2nd year will be condoned provided they
submit an undertaking that their attendance shall not be short for the
remaining duration of the course and eligible Petitioners will complete their
clinical postings as per schedule prepared by the faculty, preferably from
January, 2026, as also undertake theory classes simultaneously, wherein the
former will be conducted in the morning and latter in the evening. It is
further stated that results of 3rd year Supplementary Examinations of
Petitioners No.1, 3, 5 and 6 will be kept in a sealed cover until further
directions by the Division Bench, where LPA. No. 612/2025 is pending.
After the Division Bench permits opening of the sealed cover, the results
will be declared and if the said Petitioners are successful in the
Supplementary Examinations, they will be promoted to 4th year. However, in
the event they are unsuccessful, they will be required to take the annual 3rd
year examination.
3. Mr. Sudharshan Rajan, learned counsel for the Petitioners, on
instructions, submits that Petitioners No. 1, 3, 5 and 6 are agreeable to the
proposal given, however, insofar as Petitioners No. 2, 4, 7 and 8 are

4. In light of the amicable resolution of the issues arising in this writ
petition between the parties, the proposal submitted by the Respondents is
taken on record and accepted. Petitioners will furnish an undertaking to the
University to abide by the conditions enumerated in the e-mail dated
