By way of the present application filed under section 151 of the

Code of Civil Procedure 1908 (‘CPC’), the appellant seeks

advancement of date of hearing of CM APPL. No. 61140/2025, which

is otherwise posted before the learned Joint-Registrar on 04.05.2026.

2. For the reasons stated in the application, which is duly supported by

affidavit, the application is allowed.

3. CM APPL. No.61140/2025 is taken-up for hearing today.

4. Application stands disposed-of.

5. By way of the present application filed under section 151 CPC, the

appellant seeks stay of the impugned judgment and decree dated

26.05.2025 passed by the learned District Judge-03, South District,

Saket Courts, New Delhi in CS DJ No.520/2018.

6. Notice on the present application was issued on 24.09.2025. No reply

has been filed so far.

7. Mr. Imran Ali, learned counsel appearing for the appellant submits, that

in the meantime however, bailiff has been appointed in the execution

proceedings and the matter is listed before the learned executing court

next on 24.12.2025.

8. In the course of a brief hearing in the matter, learned counsel for the

appellant states that the appellant would be willing to deposit the

principal decretal amount in court.

9. In view of this statement, learned counsel for the respondent leaves it to

the court to pass appropriate orders.

10. Accordingly, it is directed that subject to the appellant depositing the

principal decretal amount with the Registrar General of this court

within 08 weeks from today, the effect and operation of the impugned

judgment and decree dated 26.05.2025 shall remain stayed, till the next

date of hearing before this court.

11. The Registrar General is directed to retain the amount deposited in the

form of a fixed deposit in a nationalised bank, initially for a period of

01 year; to be renewed for the same period from time-to-time, without

awaiting any further directions from this court in that behalf, unless

otherwise directed by the court.

12. The Registry is directed to bring to the notice of this court any non-

compliance with the directions issued above.

14. Since learned counsel has entered appearance on behalf of the

respondent; and in view of CM APPL. No. 61140/2025 having been

disposed-of, the date of 04.05.2026 before the learned Joint-Registrar

stands cancelled.

15. Re-notify before court for consideration on 17^th April 2026.

16. In the meantime, counsel for the parties are directed to file brief

synopses of their respective submissions, alongwith a list of judicial

precedents they seek to rely upon, not exceeding 05 pages, before the

next date; with copies to the opposing counsel.
