1. The present writ petition has been filed seeking directions to
respondent nos. 1 to 4, to take action against the illegal and unauthorized
construction being raised by respondent nos. 5 to 7, at property bearing No.
1239/1, First Floor, Katra Hussain Mirza, Farash Khana, Delhi-110006.
2. Issue notice. Notice is accepted by learned counsels appearing for the
respondents.
3. Learned counsel appearing for respondent nos. 5 to 7, submits that the
petitioner had earlier filed a suit before the Tis Hazari Courts, Delhi, which
was subsequentlywithdrawn. He, thus, submits that the present writ petition,
is an abuse of process of law. He further submits that he is carrying out only
certain alterations in its property, after giving prior intimation to the
Municipal Corporation of Delhi (“MCD”) in this regard.
4. Learned counsel appearing for respondent no. 1-MCD has handed
over to this Court, documents pertaining to the booking of the property of
respondent nos. 5 to 7, for unauthorized construction. He further submits
that a Show Cause Notice dated 17th April, 2025, for unauthorized
construction on the ground floor and first floor of the property in question,
has alreadybeen issued.
5. Learned counsel appearing for the Special Task Force (“STF”)
submits that the complaint received by the STF has already been forwarded
to the MCD.
6. At this stage, learned counsel appearing for respondent nos. 5 to 7

##PAGE3##submits that there are deviations in the propertyof the petitioner also and the
same should also be looked into.
7. In response, learned counsel appearing for respondent no. 1-MCD
clarifies that the Show Cause Notice pertains to the property of the
petitioner, as well as respondent nos. 5 to 7.
8. Accordingly, let Status Report/reply be filed by the respondents,
within a period of four weeks, from today.
9. Rejoinder thereto, if any, be filed, within a period of two weeks,
thereafter.
10. In case of any on-going construction, the same shall be stopped
forthwith, by the Station House Officer (“SHO”), Police Station-Lahori
Gate.
