I.A. 32248/2025 (under Order XXIII Rule 3 CPC)

1. This is an application filed by the plaintiff and defendant no. 2 under

Order XXIII Rule 3 Code of Civil Procedure, 1908 [‘CPC’], seeking the

recording of the settlement terms agreed between the parties for final

disposal of this suit.

2. Learned counsels for the plaintiff and defendants state that the terms

and conditions agreed between the parties have been set out at paragraph ‘6’

of the captioned application. It is prayed that the suit be decreed vis-à-vis

defendant no. 2 in terms of the said agreement.

3. This Court has perused the terms and conditions of the settlement

agreement and is satisfied that the compromise between the parties as

contained in the captioned application satisfies the requirements of Order

XXIII Rule 3 of CPC. The compromise contained in the captioned

application is lawful, and therefore, this Court does not find any impediment

in disposing of the underlying suit in terms of the aforenoted settlement vis-

à-vis defendant no.2.

4. The statement and undertakings given by the learned counsel for the

parties are accepted by this Court, and the parties are held bound by the

same.

5. Accordingly, the application stands disposed of.

6. This is an application filed by the plaintiff and defendant no. 2 under

Order XXIII Rule 3 of CPC, seeking the recording of the settlement terms

agreed between the parties for final disposal of this suit.

7. Learned counsels for the plaintiff and defendants state that the terms

and conditions agreed between the parties have been set out at paragraph ‘6’

of the captioned application. It is prayed that the suit be decreed vis-à-vis

defendant no. 3 in terms of the said agreement.

I.A. 32248/2025 and I.A. 32249/2025 shall form part of the decree.
