1. This is an application filed by the plaintiff and defendant no. 2 under Order XXIII Rule 3 Code of Civil Procedure, 1908 [‘CPC’], seeking the recording of the settlement terms agreed between the parties for final

disposal of this suit.

2. Learned counsels for the plaintiff and defendants state that the terms and conditions agreed between the parties have been set out at paragraph ‘6’ of the captioned application. It is prayed that the suit be decreed vis-à-vis

defendant no. 2 in terms of the said agreement.
