1. This writ petition is filed on behalf of the Petitioner under Article 226

of the Constitution of India seeking the following reliefs:-

“(i) Allow the present writ petition and quash and set aside the impugned

letter dated 08.09.2025 issued by the Respondents whereby the

Petitioner’s application for increase of 50 MBBS seats for the Academic

Session 2025-26 has been unlawfully rejected.

(ii) Quash and set aside the impugned order dated 10.10.2025 passed by

the Respondent No. 2 as being arbitrary, mechanical, non-speaking and

violative of the principles of natural justice.

(iii) Direct the Respondents to grant approval to the Petitioner Institute

for increase of 50 MBBS seats for the Academic Session 2025-26 onwards

and permit further rounds of counselling for admission to the said

increased 50 seats.”

2. Issue notice.

3. Counsels, as above, accept notice on behalf of the respective

Respondents.

4. Counter affidavits be filed within four working weeks from today. It

will be open to the Respondents to take an objection to the maintainability of

this writ petition on the ground that Petitioner has filed a writ petition in

Rajasthan High Court being Civil Writ Petition No. 15646/2024 seeking the

same reliefs as in this writ petition, which was dismissed on 05.11.2024 and

against which intra-court appeal is pending before the Rajasthan High Court

bearing No. 653/2024 albeit Mr. Dayan Krishnan, learned Senior Counsel

for the Petitioner refutes this objection and submits that the present writ

petition deals with increase in the intake of 50 MBBS seats for the current

academic session, whereas the writ petition filed before Rajasthan High

Court was for the academic session 2024-25 and moreover, in the present

petition challenge is laid to fresh orders passed by NMC.

5. Rejoinder, if any, be filed before the next date of hearing.

7. This application is filed on behalf of the Petitioner under Section 151

CPC seeking stay of the impugned orders as interim measure as also for a

direction to the Respondents to issue a provisional list of allocation and

allow the Petitioner institute to admit 150 students for academic year 2025-

26 in the ongoing counselling round.

8. Issue notice.

9. Counsels, as above, accept notice on behalf of the respective

Respondents.

10. Mr. Kirtiman Singh, learned Senior Counsel for Respondents No.2

and 3 submits that no interim relief can be granted since counselling is over

as also that impugned orders need adjudication and cannot be stayed as an

interim measure.

11. In my view, once the counselling rounds are over, the interim relief

sought by the Petitioner cannot be granted and the application is

accordingly, dismissed.
