1. By way of this appeal, the appellants seek setting aside of the

impugned order dated 30.05.2025, passed by the Motor Accident Claims

Tribunal [“the Tribunal”], by which their claim petition was dismissed

only on the ground of limitation.

2. Issue notice. Ms. Shruti Jain, learned counsel, accepts notice on

behalf of respondent No. 3. Notice be served upon respondent Nos. 1 and

2 by all permissible modes, including through learned counsel appearing

on their behalf before the Tribunal.

3. The question of interpretation of the limitation period for such

claims is pending before the Supreme Court in ICICI Lombard General

Insurance Co. Ltd. v. Ayiti Navaneetha & Ors. [SLP (C) 8412-

8413/2023].

4. By an order dated 04.11.2025, the Supreme Court has expedited

hearing of the said special leave petitions and directed that, in the

meantime, the Tribunals and the High Courts should not dismiss claim

petitions on the ground of limitation.

5. The Trial Court record be summoned, and an electronic copy

thereof be placed on the file of this appeal.

6. Replies to the application seeking condonation of delay be filed

within four weeks from today. Rejoinders thereto, if any, be filed within

two weeks thereafter.

7. Written submissions to the appeal be filed by the parties, with

reference to the electronic record of the Court, alongwith copies of any

relevant judgments which they wish to rely upon, within eight weeks

from today, without prejudice to their rights and contentions in the

pending application.

8. List before the learned Registrar on 27.01.2026, for completion of

service and pleadings.
