1. The appellant – Reliance General Insurance Company Limited

[“Insurance Company”] is in appeal against an award of the Motor

Accident Claims Tribunal [“Tribunal”] dated 27.09.2025, in MACT No.

519/2013, whereby the Tribunal has awarded a sum of Rs. 49,57,000/-,

alongwith interest at the rate of 8% per annum, in favour of respondent

Nos. 1 to 4 – claimants.

2. Issue notice. Notice be served upon respondent Nos. 1 to 4 by all

permissible modes, additionally through learned counsel appearing on

their behalf before the Tribunal. As no recovery rights have been granted

to the Insurance Company against the owner and driver of the vehicle,

service upon respondent No. 5 is dispensed with.

3. The challenge of the Insurance Company is limited to the

quantification of the income of the deceased, on the basis of which the

loss of dependency has been computed.

4. Mr. Pankaj Gupta, learned counsel for the Insurance Company,

refers to the salary slip of the deceased, which has been annexed to the

appeal as Annexure A2, to submit as follows:

a. That certain allowances are included in the salary slip, which ought

to have been deducted from the income of the deceased.

b. That the Tribunal has not deducted any taxes.

c. That the Tribunal has taken income to be Rs. 30,000/- per month,

whereas, even inclusive of allowances, the monthly income of the

deceased was Rs.27,500/- per month.

5. The Trial Court record be summoned, and an electronic copy

thereof be placed on the file of this appeal.

6. Upon the Insurance Company depositing the entire awarded

amount, alongwith up-to-date interest, with the Tribunal within a period

of six weeks from today, execution of the impugned award shall remain

stayed.

7. Having regard to the aforesaid grounds taken by Mr. Gupta, 70%

of the awarded amount be released to respondent Nos. 1 to 4 [claimants

before the Tribunal] in accordance with the disbursement scheme

provided in the impugned award.

8. Written submissions to the appeal be filed by the parties, with

reference to the electronic record of the Court, alongwith copies of any

relevant judgments which they wish to rely upon, within eight weeks
