1. The Petitioner, a convict serving life sentence in FIR No. 131/2010
under Sections 397/302/34 of the Indian Penal Code, 1860 registered at P.S.
Pandav Nagar, seeks emergency parole on account of the demise of his
brother. The Petitioner was earlier released on one-day’s custody parole on
17th December, 2025 for performing the last rites of his brother. The demise
of the Petitioner’s brother has been verified by the State.
2. The Petitioner now seeks parole to perform the remaining rituals and
to meet his family during this period of grief.
3. As per the nominal roll, which was taken note of by this Court in
W.P. (CRL) 3243/2025, the Petitioner has remained in custody for nearly 16
years, including remission. His jail conduct for the last one year has been

##PAGE2##recorded as satisfactory. The Petitioner has also been granted parole and
furlough on multiple occasions in the past.
4. It is pointed out that one of the Petitioner’s co-convicts is presently on
parole.
5. However, having regard to the exceptional circumstances arising from
the demise of the Petitioner’s brother, he is entitled to be released on parole
notwithstanding Rule 1212 of the Delhi Prison Rules.
6. Accordingly, the Petitioner is directed to be released on parole for a
period of four weeks from the date of release subject to furnishing cash
surety and personal bond in the sum of INR 25,000/- (Rupees Twenty Five
Thousand only) to the satisfaction of the Jail Superintendent subject to the
following conditions:-
(i) During the period of parole, the Petitioner shall mark his physical
presence before the SHO, Police Station Pandav Nagar, Delhi, once every
fortnight, at 4:00 PM.
(ii) The Petitioner shall also provide the SHO, Police Pandav Nagar,
Delhi with mobile telephone number which shall be kept in working
condition at all times and shall not switch off or change the mobile number
without prior intimation to the SHO concerned.
(iii) The Petitioner shall not leave the National Capital Territory of Delhi
during the period of parole, without the prior permission of this Court.
(iv) The Petitioner shall not indulge in any criminal activity and shall not
communicate with or come into contact with the complainant/victim or any
member of the complainant/victim’s family, nor shall he tamper with the
evidence of any other case/FIR in which he is involved.

7. Copy of the order be sent to the concerned Jail Superintendent for
information and necessary compliance.
8. Accordingly, the petition is disposed of.
