1. This application has been filed by the plaintiff seeking condonation of

delay of forty three (43) days in re-filing the present suit.

2. Taking into account the period of delay and for the reasons stated in the application, the same is allowed. The delay of 43 days in re-filing the

present suit stands condoned.

3. Pursuant to the order passed by this Court on 8^th December 2025, affidavit of service has been filed on behalf of the plaintiff in terms of which

the defendants have been served.

4. Let the plaint be registered as a suit.

5. None appears on behalf of the defendants despite service.

6. Issue summons.

7. Summons be issued to the defendants through all permissible modes.

8. The summons shall state that the written statement(s) shall be filed by the defendants within thirty (30) days from the date of the receipt o
