1. The present application has been filed on behalf of respondent nos. 3
and 4, seeking vacation of the status quo order dated 12th December, 2025,
qua the property bearing No. N-60½ , 100 square yards, Kirti Nagar, New
Delhi-110015.

##PAGE2##2. Learned Senior Counsel appearing for the respondent nos. 3 and 4
submits that respondent nos. 3 and 4 have also applied for regularization on
19th December, 2025. He, thus, submits that the regularization application of
respondent nos. 3 and 4 be duly considered by the Municipal Corporation of
Delhi (“MCD”).
3. Issue Notice. Notice is accepted by learned counsels appearing for the
petitioner and respondent nos. 1 and 2.
4. Learned counsel appearing for respondent no. 1-MCD submits that
the regularization application of the respondent nos. 3 and 4, has already
been rejected today, i.e., 22nd December, 2025. He has further handed over
to this Court a copy of the Show Cause Notice dated 22nd December, 2025,
and submits that due action shall be taken as per law.
5. At this stage, learned Senior Counsel appearing for respondent nos. 3
and 4 submits that since the application for regularization has been rejected
shall seek their remedies against the said rejection, in accordance with law.
6. The aforesaid statement is taken note of.
7. Needless to state, as and when, any such challenge is made to the
rejection of the regularization application, the same shall be considered, in
accordance with law.
8. Learned Senior Counsel appearing for the petitioner, at this stage, has
handed over to this Court, photographs of the property in question, which
are reproduced as under:

##PAGE6##9. By referring to the aforesaid photographs, learned Senior Counsel
appearing for the petitioner submits that earlier the property in question
existed only till the ground floor and first floor. However, now the property
has been constructed till the fifth floor. She, thus, submits that the whole
property is unauthorized.
10. She further submits that the present is a case of sub-division of the
property.
11. Accordingly, let replies be filed by the non-applicants, within a period
of four weeks, from today.
12. MCD is also at liberty to inspect the property of the petitioner, a
