3. The present writ petition has been filed by the petitioner, a life
member of the Indian Sociological Society (“ISS”), and a Senior Academic,
challenging the action of the respondents in withholding declaration of the
ISS Elections 2025 results, after conclusion of polling and public display of
results, and thereafter, cancelling the petitioner’s candidature debarring him
from contesting elections for ten years, and removing him from an elected
academic office.
4. Learned Senior Counsel appearing for the petitioner submits that the
ISS Elections 2025 were conducted through online voting system operated
by a private vendor appointed by the ISS. The Polling had commenced on
12th November, 2025 and concluded on 19th November, 2025. During the
subsistence of polling, technical anomalies which permitted repeated access
to the ballot without confirmation E-mails were noticed by several life
members of the said society. Thus, the petitioner reported these anomalies to
the Election Commission and the vendor.
5. Learned Senior Counsel appearing for the petitioner has drawn the

##PAGE3##anomalies. To this, reply was received on the same date, i.e., 12th November,
2025, wherein, it was stated that the said issue was taken care of. Attention
of this Court has also been drawn to the Annexure P-8, which is a letter
dated 14th November, 2025, issued by the President and the Secretary of the
ISS, wherein, they have assured that all duplicated votes were nullified
automatically and only the first vote was considered valid, ensuring
compliance of the rules.
6. Learned Senior Counsel appearing for the petitioner has also drawn
the attention of this Court to the notices attached as Annexure P-7, wherein,
on behalf of the ISS, it was stated in clear terms that the vote is safe and the
election is secured. Learned Senior Counsel also relies upon the notice dated
the attention of this Court to the following paragraph:
Duplicate Voting Attempts:
The system recorded multiple attempts to cast more than one vote
from the same user credentials. All duplicated votes were nullified
automatically and only the first vote was considered valid ensuring
compliance with rules.
