The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950, assailing the order dated 20th November, 2025,passed bylearnedtrial courtin CS(COMM)No.634/2022,wherebyan application under Order XVI Rule 1 read with Rule 6 and 151 of Code of Civil Procedure, 1908 for summoning of witnesses from GST Department along with certain documents has been dismissed.

5. ThisCourthasheardthelearnedCounselforthepetitioner/plaintiffand perused the record.

6. Learned counsel for the petitioner/plaintiff submits that the learned trial court has passed the impugned order on the basis of surmises and conjectures and the same is contrary to settled principle
