This application under Section 430 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the accused in Sessions Case No. 77/2023 on the file of Additional Sessions Judge-01 (POCSO), North West, Rohini Courts, Delhi, seeking suspension of sentence.The appellant/accused has been found guilty of the Vide offences punishable under Sections 354 and 354B IPC. order on sentence dated 23.04.2025, the appellant has been sentenced to undergo rigorous imprisonment for a period of 7 years for the offence punishable under Section 354B IPC and fine of ₹30,000/-
and in default of payment of fine to undergo simple imprisonment for 06 months. The nominal roll dated 14.01.2026 says that he has already served a period of 3 years and 29 days.
2. The learned Additional Public Prosecutor submits that the accused-appellant has no criminal antecedents.
