O R D E R

1. This application under Section 430 of the BharatiyaNagarik Suraksha Sanhita, 2023, has been filed on behalf of the accused in Sessions Case No. 28171/2016 on the file of Additional Sessions Judge (FTC)-02, Central District, Tis Hazari Courts, Delhi, seeking suspension of sentence during pendency of the appeal. The appellant has been found guilty of the offence punishable under Sections 307 read with Section 34 of the Indian Vide Penal Code, 1860. order dated 21.05.2025, he has been sentenced to undergo rigorous imprisonment for seven years along with fine of ₹1,000/- and in default of payment of fine, simple imprisonment for two months.
2. The learned counsel for the appellant submits that out of the sentence of seven years, the appellant has already served more than four years.
3. It has been brought to my notice that the co-accused, who is the appellant in CRL.A.952/2025, has already been granted suspension of sentence vide order dated 28.11.2025. Hence, the sentence imposed upon the appellant is suspended during the pendency of the appeal on executing a personal bond of ₹25,000/- with two solvent sureties for the like amount each to the satisfaction of the trial court, subject to the following conditions:-
(i) The appellant shall not commit any offence(s) while on bail and shall appear before this Court as and when directed.
(ii) The appellant shall provide his mobile number and residential address to the Station House Officer (SHO) concerned, on which he shall remain available. In case of change of his mobile number or residential address, the appellant shall promptly inform the SHO concerned as well as this Court.
(iii) The appellant shall not leave the country without the prior permission of this Court. If he owns a passport, he shall surrender the same before the trial court. If he does not have a passport, he shall file an affidavit to the said effect.
(iv) Needless to say, in the event of violation of any of the aforementioned condition(s), the suspension of sentence granted shall forthwith stand cancelled.
4. With the above directions, the application is disposed of.
5. A copy of this order be communicated electronically to theJail Superintendent concerned for information and compliance.
