O R D E R

% 29.01.2026 CRL.M.(BAIL) 932/2025

1. This application under Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) read with Section 528 BNSS has been filed seeking suspension of the sentence of the applicant/accused in SC No. 1983/2016, on the file of the learned Principal District & Sessions Judge, East, Karkardooma Courts, Delhi. The applicant/accused has been found guilty of the offence vide punishable under Section 308 IPC judgement dated 01.04.2025 and has been sentenced to undergo rigorous imprisonment for a period of 5 years and fine of ₹50,000/- and in default of payment of fine, to undergo simple imprisonment for a period of 6 months.

2. It is submitted by the learned counsel for the appellant/

accused that out of 5 years, as on today, he has served nearly one year.

3. The learned Additional Public Prosecutor submits that the appellant/ accused has no criminal antecedents.

4. Heard both sides.

5. The sentence is only for a period of 5 years out of which the appellant/ accused has served nearly one year. The appellant/ accused has no criminal antecedents also. The appeal is of the year 2025. There is no possibility of the appeal being taken up in the near future for hearing. Hence, the sentence is suspended during the pendency of the appeal on execution of a personal bond of ₹15,000/- with two solvent sureties of the like amount each to the satisfaction of the trial court subject to the following conditions:-

a. The appellant shall not commit any offence(s) while on bail and shall appear before this Court as and when directed;

b. The appellant shall give his mobile number/address to the Station House Officer (SHO) concerned on which he shall be available and if he changes his mobile number/address, he shall inform the same to the SHO concerned without delay.

6. The application is disposed of as aforesaid.

7. A copy of this order be communicated electronically to the Jail Superintendent concerned for information and necessary compliance.
