1. This suit is instituted on behalf of the Plaintiffs inter alia seeking permanent injunction restraining the Defendant from infringing the trademarks of the Plaintiffs, passing off their goods and services as that of the Plaintiffs.

2. Plaintiffs are part of the Verizon Group of Companies, founded in the year 2000. Plaintiffs coined and adopted the trademark VERIZON, which comes from Latin word ‘Veritas’ and ‘Horizon’. Plaintiffs are stated to be among the world’s leading providers of inter alia communications, information technology and security products and services and own and operate one of the most expansive end-to-end global Internet Protocol networks serving more than 2,700 cities in over 150 countries, including India. Plaintiffs have secured registrations in over 200 countries, with the earliest registration in India dating back to year 2000, details of which are furnished in the plaint. Plaintiffs’ VERIZON trademarks have been declared ‘well-known’ as per Section 2(1)(zg) of The Trade Marks Act, 1999 vide judgment and decree dated 11.07.2023 in CS(COMM) No. 220/2023.

On discovering in December, 2024 that Defendant had third party listings available online pertaining to ‘VERIZON007 WORLDWIDE CONSTRUCTION SERVICES’, wherein it claimed to be a full service construction company, Plaintiffs visited and perused the third party domains and found that Defendant was not only using the VERIZON trademark but had also registered a company under the name VERIZON007 WORLDWIDE CONSTRUCTIONS & SERVICES PVT. LTD., which has completely subsumed Plaintiffs’ trademark VERIZON and the trademark is being used repeatedly to promote and advertise its services on various third parties platforms.

Plaintiffs thereafter filed the present suit and vide order dated 30.05.2025, Court granted ex parte ad interim injunction restraining the Defendant and all others acting on its behalf from marketing, selling etc., goods or services using the trademarks VERIZON, VERIZON007 and VERIZON007 WORLDWIDE CONSTRUCTION SERVICES and/or its variants similar to Plaintiffs’ VERIZON trademarks.

Defendant has entered appearance and Mr. Siddharth Vardhman, learned counsel for the Defendant, on instructions, submits that Defendant shall not use the impugned trademarks VERIZON, VERIZON007, VERIZON007 WORLDWIDE CONSTRUCTION SERVICES and/or any other trademark, which is identical/similar/deceptively similar to Plaintiffs’ VERIZON trademark and is willing to file an undertaking to this effect. It is also submitted that Defendant shall henceforth cease operation of its company bearing the name VERIZON007 WORLDWIDE CONSTRUCTIONS & SERVICES PVT. LTD and take necessary steps for removal of the name from the Register of Companies.

6. The undertaking given by the Defendant is taken on record. Defendant shall file an affidavit of undertaking within two weeks from today and needless to state that it shall be bound by the undertaking given to the Court.

7. Accordingly, the suit is decreed in terms of paragraph 89(i), (ii) and (iii) of the plaint.

8. Plaintiffs are held entitled to recover the actual costs of the proceedings, for which bill of costs shall be filed within two weeks from today. The matter shall be placed before the Taxing Officer on 23.02.2026, for computation of costs in terms of the Commercial Courts Act, 2015 and Rule 5 of Chapter XXIII of Delhi High Court (Original Side) Rules, 2018 read with Delhi High Court Intellectual Property Division Rules, 2022.
