O R D E R

1. This application under Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the appellant/accused in CC No. 33/2021 on the file of Special Judge, CBI-19 (PC ACT), RADC, New Delhi, seeking suspension of sentence during pendency of the appeal. As per the impugned judgment dated 25.08.2025, the appellant has been found guilty of the offences punishable under Section 7 of the Prevention of Corruption Act, 1988 (the PC Act) and Section 120B of the Indian Vide Penal Code, 1860 (IPC) read with Section 7 of the PC Act. the order on sentence dated 09.09.2025, the appellant has been sentenced to undergo simple imprisonment for a period of five years along with fine of ₹1,00,000/- and in default of payment of fine, simple imprisonment for a period of six months for the offence punishable under Section 7 of the PC Act and simple imprisonment for a period of four years along with fine of ₹1,00,000/- and in default of payment of fine, simple imprisonment for a period of six months for offence punishable under Section 120B IPC read with Section 7 of the PC Act.

2. It is submitted by the learned counsel for the appellant/accused that the appellant has already served a period of about five months and that he has no criminal antecedents and therefore, his sentence may be suspended.

3. The application is opposed by the learned Additional Public Prosecutor.

4. Heard both sides.

5. The sentence of imprisonment is only for a period of five years. The appellant/accused has no criminal antecedents. Since the appeal is of the year 2025, there is no possibility of the appeal being heard in the near future.

Hence, in the facts and circumstances of the case, sentence is suspended during the pendency of the appeal on execution of a personal bond of ₹25,000/- with two solvent sureties for the like amount each to the satisfaction of the trial court and deposition of fine amount, subject to the following conditions:-

(i) The appellant shall not commit any offence(s) while on bail and shall appear before this Court as and when directed.

(ii) The appellant shall provide his mobile number and residential address to the Station House Officer (SHO) concerned, on which he shall remain available. In case of change of mobile number or residential address, the appellant shall promptly inform the SHO concerned as well as this Court.

(iii) The appellant shall appear before the Court as and when directed.

(iv) The appellant shall not leave the country without the prior permission of this Court. If he owns a passport, he shall surrender the same before the trial court. If he does not have a passport, he shall file an affidavit to the said effect. (v) He shall deposit the fine amount within a period of four weeks.

(vi) Needless to say, in the event of violation of any of the aforementioned condition(s), the suspension of sentence granted shall forthwith stand cancelled.

7. With the above directions, the application is disposed of.

8. A copy of this order be communicated electronically to the Jail Superintendent concerned for information and compliance.
