1. The present writ petition has been filed on behalf of the petitioner seeking direction to the respondents no.1 and 2/ MCD to demolish and seal the unauthorized construction on the property of the respondent no.5, bearing property no. C-19, Gali No. 13, new Govind Pura, Delhi-110051 (hereinafter ‘subject property’).
2. None appears on behalf of the petitioner.
3. Status Report has been filed on behalf of MCD stating that the petitioner resides far away from the premises of the subject property of the respondent no.5, in respect of which demolition is sought.
4. Counsel appearing on behalf of MCD submits that the demolition order has been issued on 2nd December, 2025.
5. Counsel appearing on behalf of the respondent no.4/ Delhi Police submits that currently no fresh construction is going on in the subject property.
6. Status Report has been filed on behalf of the respondent no.4/ Delhi Police.
6.1. However, the same is not on record.
6.2. The delay in filing the Status Report is condoned.
6.3. Counsel for the respondent no.4 shall take steps to have the status report placed on record.
7. Counsel appearing on behalf of the respondent no.3/ DDA also submits that a Status Report has been filed on behalf of the respondent no.3/
DDA stating that DDA has no role in the present petition.
7.1. However, the same is not on record.
7.2. The delay in filing the Status Report is condoned.
7.3. Counsel for DDA shall take steps to have the Status Report placed on record.
8. Taking note of the submission of the respondent no.1/ MCD that a demolition order has been passed in respect of the subject property, the present petition stands disposed of.
9. Needless to state, all rights and contentions of the respondent no.5/
the owner/ occupier of the subject property shall remain open.
10. Consequently, all pending applications stand disposed of.
