2. Allowed, subject to all just exceptions. Accordingly, the application is disposed of.
CRL.M.A. 2323/2026 (for delay)
3. This is an application seeking condonation of delay of 8 days in filing the present appeal.
4. For the reasons stated in the application, the same is allowed.
5. The application is disposed of in above terms.
CRL.A. 83/2026 & CRL.M.(BAIL) 147/2026
6. The present appeal has been filed u/s 415 read with Section 528 of BNSS, 2023 against the judgment and order on Sentence dated 4th November, 2025 passed by the Additional Sessions Judge (West), Tis Hazari Court, New Delhi. By the impugned judgment dated 4th November, 2025, the Appellant hasbeenconvictedofoffencesunderSection6ofthePOCSOActandSection
376 of the IPC.
7. Vide CRL.M.(BAIL) 147/2026, the Appellant seeks suspension of sentence on the ground that he has served almost 10 years in custody.
8. CRL.A. 83/2026 is admitted.
9. Issue notice in CRL.M.(BAIL) 147/2026. Mr. Bahri, ld. APP accepts notice on behalf of the Respondent. Let a status report be filed by the Respondent before the next date of hearing.
10. Let notice be also issued to the Prosecutrix in the matter through the concerned SHO.
11. Further, let the Trial Court Record be requisitioned in this matter and be tagged with the appeal. The Registry is directed to prepare the appeal paperbook with proper indexing, pagination and bookmarks expeditiously.
12. A copy of the TCR, as also the paperbook be provided to ld. Counsels appearing on behalf of the parties, upon request.
13. Let the latest nominal roll of the Appellant be also requisitioned and brought on record before the next date of hearing.
14. The Appellant shall also file an affidavit of past criminal antecedents of the Appellant, which shall also be verified by the ld. APP, who shall also file a status report in this regard.
15. Let written submissionsbe also filedonbehalf of all parties atleastone week before the next date of hearing.
16. The physical TCR be requisitioned to the Court on the next date of hearing by the Registry.
17. Let notice be also issued to the Secretary, DLSA, West, in this matter, who shall apprise the Court upon the status of disbursal of the compensation awarded to the prosecutrix vide impugned judgment dated 4th November, 2025.
