3. Ms. Karishma Maria, Adv. has appeared on behalf of the petitioner and submitted that she has filed the vakalatnama yesterday. However, the same is not on record. The vakalatnama be taken on record.

This public interest litigation petition seeks a direction to be issued to the respondents directing them to take action in respect of certain alleged unauthorized/ illegal construction and encroachments existing in and around the areas of (1) Saidulajab, Paryavaran Complex, (2) Freedom Fighter Colony, Neb Sarai, (3) Maidan Garhi, (4) Rajpur, (5) Chhattarpur, (6) Lado Sarai and (7) adjoining areas in South Delhi in New Delhi;
5. Certain other prayers have also been made, however, the primary prayer is in respect of removal of the unauthorized encroachment.
6. Though the writ petition reveals that the petitioner, in the past, has made various representations bringing to the notice of the MCD and other concerned authorities the encroachments and illegal constructions, however, little seems to be done till now.

Since the subject matter of the writ petition covers a large number of properties situated in different areas in South Delhi, we find it appropriate to permit the petitioner to approach the concerned authorities of MCD and Special Task Force, DDA by way of making a representation in respect of the illegal encroachments/ constructions in each of the aforesaid area, separately giving details of such constructions.

The said representation shall be made within a fortnight from today and, in case, any such representation is made, the appropriate authorities of the MCD shall carry out a survey of the area to find out as to whether there are illegal encroachments/ constructions and, accordingly, report the matter for taking appropriate action to the authorities concerned, including the authority of Special Task Force or any other appropriate authority.

The survey shall be conducted expeditiously and the report in respect of each of the areas shall also be sent by the MCD, if any encroachments or illegal constructions are found, within the shortest possible time. We further direct that upon receipt of the report of the survey conducted by the MCD, the authorities, including the authorities of Special Task Force, DDA shall take action which will be warranted under law after giving notice to all those who are likely to be affected by such action.
10. We also direct that the report of the survey and the action which may be taken thereafter shall also be furnished to the petitioner.
11. The writ petition stands disposed of.
