O R D E R

1. This application under Section 430 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking suspension of sentence of the appellant/accused in Sessions Case No. 334/2021 on the file of the learned Principal District & Sessions Judge, New Delhi District, Patiala House Courts, Delhi. The appellant/accused has been convicted for the offence vide punishable under Section 307 of the Indian Penal Code, 1860 vide judgment dated 19.10.2024 and has been sentenced order on sentence dated 16.05.2025 to undergo rigorous imprisonment for a period of seven years along with fine to the tune of ₹5,000/-, and in default of payment of fine, to simple imprisonment for a period of three months. The benefit of Section 428 of the Code of Criminal Procedure, 1973 has been granted to the appellant/accused.

2. The appellant/accused has served about one year and five months and he has no criminal antecedents.

3. In the facts and circumstances of the case, the sentence is suspended during the pendency of the appeal on execution of a personal bond of ₹15,000/- with two solvent sureties for the like amount each to the satisfaction of the trial court, subject to the following conditions:-

(i) The appellant shall not commit any offence(s) while on bail and shall appear before this Court as and when directed.

(ii) The appellant shall provide his mobile number and residential address to the Station House Officer (SHO) concerned, on which he shall remain available. In case of change of mobile number or residential address, the appellant shall promptly inform the SHO concerned as well as this Court.

(iii) The appellant shall not directly/indirectly contact the victim or any of the other prosecution witnesses.

(iv) The appellant shall not leave the country without prior permission of this Court.

(v) Needless to say, in the event of violation of any of the aforementioned condition(s), the suspension of sentence granted shall forthwith stand cancelled.

4. With the above directions, the application is disposed of.

5. A copy of this order be communicated electronically to the Jail Superintendent concerned for information and compliance.
