O R D E R

% 21.01.2026 I.A. 1682/2026 (exemption)

1. This is an application on behalf of the plaintiff seeking exemption from filing original and fair typed copies of documents.

2. The application is allowed, subject to the plaintiff granting inspection of the documents filed, as and when, he is required to do so, or filing the original documents at the stage of admission/denial.

3. The application stands disposed of.

I.A. 1683/2026 (Under Section 149 read with Section 151 CPC by the plaintiff)

4. This is an application seeking extension of time of two weeks to file requisite Court Fee.

5. Mr. Abhijat Bal, learned Sr. Counsel appearing on behalf of the plaintiff undertakes to file the deficient Court Fee within a period of two weeks from today. The statement is taken on record.

6. Application stands disposed of.

7. The plaint be registered as a suit.

8. Issue summons to the defendants byall permissible modes.

9. Mr. Shahryar Khan, learned counsel appearing on behalf of defendant no.1 accepts notice and waives the formal service of summons. He submits that complete copy of the paper book including plaint, applications and the documents have been received by them. Let written statement be filed within 30 days from today.

10. On plaintiff taking steps, summons be issued to the unrepresented defendant nos. 2 and 3 by all permissible modes returnable on 01.04.2026. The summons shall indicate that written statement must be filed within thirty days from the date of receipt of summons.

11. The defendants shall also file an affidavit of admission/denial of the documents filed bythe plaintiff, failing which the written statement shall not be taken on record.

12. The plaintiff is at liberty to file replication thereto within thirty days after filing of the written statement. The replication shall be accompanied by affidavit of admission/denial in respect of the documents filed by the defendants, failing which the replication shall not be taken on record.

13. It is made clear that any unjustified denial of documents may lead to an order of costs against the concerned party.

14. Any party seeking inspection of documents may do so in accordance with the Delhi High Court (Original Side) Rules, 2018.

15. List before the learned Joint Registrar for completion of pleadings, service, admission of denial of documents and marking of exhibits on

01.04.2026.

16. List before Court on 13.04.2026 for hearing.

I.A. 1681/2026 (Under Order XXXIX Rule 1 and 2 CPC by the plaintiff)

17. Issue notice.

18. Mr. Shahryar Khan, learned counsel appearing on behalf of defendant no.1 accepts notice. On instructions, Mr. Khan submits that no proceedings pursuant to the show-cause notice dated 19.12.2025 shall be undertaken till the next date of hearing. The statement is taken on record and defendant no.1 is bound down to the same.

19. On plaintiff taking steps, issue notice to defendant nos. 2 and 3 by all permissible modes returnable before learned Joint Registrar for completion of service and pleadings on 01.04.2026.

20. Let reply to the application be filed within a period of two weeks.

Rejoinder thereto be filed before the next date of hearing.

21. List before Court on 13.04.2026 for hearing.
