3. This application is filed by the Petitioner under Section 151 CPC seeking permission for filing lengthy list of dates and events and brief synopsis.

This writ petition is filed by the Petitioner seeking a direction to the Controller General of Patents, Designs and Trade Marks (‘Controller’) to expeditiously decide the pending TM-P application dated 02.04.2024 for recordal of assignment in respect of trademark application No. 3801356 in Class 09 for the mark TENDA/ .

7. Petitioner avers that earlier proprietor Shenzhen Tenda Technology Co. Ltd. filed a trade mark application bearing No. 3801356 in Class 09 for registration of the mark TENDA/ on 10.04.2018. The mark was registered on 09.10.2021 in Class 09 in the name of the proprietor. On 22.03.2024, through a duly executed Deed of Assignment between Shenzhen Tenda Technology Co. Ltd. and the Petitioner, the former assigned for said trademark in favour of the Petitioner and accordingly, the Petitioner filed a request on 02.04.2024 for recordal of assignment under Section 45 of the Trade Marks Act, 1999 (‘1999 Act’) by submitting requisite Form TM-P and requested entry of Petitioner’s name in the Register in respect of registered trademark TENDA/ .

Learned counsel for the Petitioner submits that registered trademark TENDA/ has been duly assigned to the Petitioner vide Assignment Deed dated 22.03.2024 and immediately a request was made to the Registrar of Trade Marks to enter the name of the Petitioner in the Register and requisite documents, including Form TM-P was submitted. However, despite the request made to the Registrar, followed by reminders dated 25.06.2024, 04.09.2024, 16.05.2025 and 27.06.2025, no action has been taken by the Respondent. He further submits that Respondent issued notice dated 28.08.2025 to the previous proprietor Shenzhen Tenda Technology Co. Ltd., seeking its ‘no objection’ to recordal of the trademark. On receipt of copy of the notice, Petitioner filed a detailed reply enclosing a duly notarized and apostilled ‘No Objection Certificate’ issued by Shenzhen Tenda Technology Co. Ltd. confirming its consent to the assignment and recordal of ownership in favour of the Petitioner. However, till date, no steps have been taken for recordal of assignment and even the response to RTI application dated 25.11.2025, throws no light on the current status of the request made by the Petitioner.

11. From the narrative in the writ petition, it emerges that Shenzhen Tenda Technology Co. Ltd. had filed trademark application for registering the trademark TENDA/ in Class 09 on 10.04.2018 and the trademark was registered on 09.10.2021. Through a Deed of Assignment dated 22.03.2024, Shenzhen Tenda Technology Co. Ltd. assigned the said trademark in favour of the Petitioner, who immediately requested the Respondent for recordal of assignment under Section 45 of 1999 Act and also submitted Form TM-P requesting for entry of its name in respect of the registered trademark.
