1. The Petitioners, who are ex-servicemen retired from the Indian Army on different dates and who joined the services of Respondent No. 6 Bank/Bank of India,, “BoI” after 1st January, 2006, have approached this Court seeking fixation of their pay on re-employment with the Respondent Bank by extending to them the benefit of the Sixth Central Pay Commission.
2. In support of their claim, reliance is placed on an Office Memorandum dated 5th April, 2010 issued by the Department of Personnel & Training, annexed as Annexure P-4 to the petition. It is further contended
